• Payment data: billing information processed exclusively through our third-party payment processor (Stripe). We do not store full card details on our systems.

• Communications data: the content of messages sent to us via contact forms, email or WhatsApp Business.

3. Legal Basis for Processing

We process personaal data on the following legal grounds:

• Contract performance – to provide and fulfil the travel consultancy services you have requested.
• Legitimate interests – to improve our services, to communicate with you about your booking and to prevent fraud.
• Consent – for marketing communications (email newsletter), where you have explicitly opted in. Consent may be withdrawn at any time.

5. Third Parties and Data Sharing

• Stripe, Inc. — payment processing. Please refer to Stripe's own Privacy Policy for details of their data practices.
• Google LLC — website analytics via Google Analytics. Data collected is anonymised and aggregated.
• Email marketing platforms (to be introduced in the future) — if you subscribe to our newsletter, your email address will be processed by the relevant platform provider.

We do not sell, rent or otherwise commercially transfer your personaal data to third parties.

6. International Transfers

Some of our third-party providers are based outside Brazil. Where data is transferred internationally, we ensure appropriate safeguards are in place in accordance with the LGPD and, where applicable, the GDPR (e.g. Standard Contractual Clauses or adequacy decisions).

Booking-related data is generally retained for five (5) years following the conclusion of services, in accordance with Brazilian civil and tax legislation. 1. Identification of the Service Provider

These Terms of Use govern the relationship between Tupinambá Global Ltda, trading as Tupi Tour (CNPJ 62.968.960/0001-05, Alameda Jaú, 135, São Paulo – SP, CEP 01420-001, Brazil; email: [email protected]) and any persona ("Client") who accesses this website or engages Tupi Tour's consultancy services.

2. Naturaleza de los Servicios — Condición de Intermediario

Tupi Tour provides personaalised travel consultancy: curating destinations, recommending itineraries, selecting accommodation and experiences, and coordinating bookings with independent third-party providers. In all cases:

• Tupi Tour acts as agent and consultant, not as the principal provider of travel services.
• The contracts for the underlying travel services (accommodation, transport, tours, activities, etc.) are formed directly between the Client and the relevant third-party supplier.
• Tupi Tour's remuneration may include a consultancy fee, commission from suppliers, or a combination of both, which will be disclosed to the Client upon request.

3. Alcance de la Consultoría y Responsabilidad

Tupi Tour's consultancy constitutes a professional recommendation based on the information available at the time of consultation. Recommendations do not constitute guarantees of quality, suitability or outcome.

Tupi Tour is not liable for:

• Acts or omissions of third-party service providers (hotels, transport operators, local guides, activity providers, airlines, etc.).
• Cancellations, delays, overbooking or changes made by third-party providers.
• Accidents, injuries, illness, loss, damage or any other harm arising during the execution of services by third-party providers.
• Force majeure events, including but not limited to natural disasters, political unrest, pandemics, adverse weather conditions or government travel restrictions.
• Changes in prices quoted by third-party providers after the initial consultancy. All quotations are estimates subject to confirmation by the relevant supplier.

4. Honorarios de Consultoría

Where Tupi Tour charges a separate consultancy fee, this fee is non-refundable once the consultancy has been delivered, as it compensates for professional services already rendered. The scope of the consultancy for which the fee applies will be agreed in writing prior to payment.

5. Política de Cancelación y Reembolso

Cancellation and refund conditions for third-party travel services (accommodation, tours, activities) are governed exclusively by the policies of the relevant supplier. Tupi Tour will:

• Inform the Client of the applicable cancellation and refund policy prior to booking.
• Act as intermediary in processing cancellation requests on the Client's behalf.
• Not be liable for any amounts retained or penalties imposed by third-party providers.

Refunds of amounts paid to Tupi Tour for subsequent remittance to suppliers are conditional on Tupi Tour recovering those amounts from the supplier. Where direct payment to the supplier has been processed via Stripe, the Client must engage directly with the supplier's refund process.

6. Precios y Pagos

• All prices displayed on this website are indicative and subject to availability and confirmation by the relevant third-party provider at the time of booking.
• Prices are generally quoted in US Dollars (USD). Currency conversion and bank charges are the Client's responsibility.
• Payments processed via this website are handled by Stripe, Inc. Tupi Tour does not store card data. The Client's use of Stripe is subject to Stripe's own Terms of Service.
• Tupi Tour reserves the right to update prices at any time without prior notice. Any price change occurring after a confirmed booking will not affect that booking.

7. Responsabilidades del Cliente

The Client is responsible for:

• Ensuring that all information provided to Tupi Tour (names, travel dates, passport details, dietary requirements, medical conditions, etc.) is accurate and complete.
• Holding valid travel documents (passport, visa, travel insurance) appropriate for the destinations visited. Tupi Tour does not provide visa or immigration advice.
• Obtaining adequate travel insurance, including medical, accident and trip-cancellation coverage, prior to departure. Tupi Tour strongly recommends comprehensive travel insurance for all itineraries.
• Complying with the rules and requirements of all third-party service providers engaged on the Client's behalf.
• Informing Tupi Tour in advance of any special requirements, health conditions or mobility limitations relevant to the services requested.

8. Propiedad Intelectual

All content on this website — including text, images, logos, itineraries and descriptions — is the property of Tupinambá Global Ltda and is protected by applicable intellectual property law. No content may be reproduced, distributed or used for commercial purposes without the prior written consent of Tupinambá Global Ltda.

9. Uso del Sitio Web

This website is provided for information purposes and to facilitate the engagement of Tupi Tour's consultancy services. Tupi Tour reserves the right to modify, suspend or discontinue any part of the website at any time without notice. Tupi Tour accepts no liability for interruptions to website availability.

10. Limitación de Responsabilidad

To the maximum extent permitted by applicable law, Tupi Tour's total liability to the Client in connection with any consultancy engagement shall not exceed the consultancy fee actually paid by the Client to Tupi Tour for the specific engagement giving rise to the claim. This limitation does not apply to liability arising from gross negligence or wilful misconduct on the part of Tupi Tour.

11. Ley Aplicable y Resolución de Disputas

These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the District of São Paulo, State of São Paulo, Brazil, without prejudice to any mandatory consumer protection rights that may apply in the Client's country of residence.

Tupi Tour is committed to resolving disputes amicably. Prior to initiating formal proceedings, the parties agree to engage in good-faith negotiations for a period of thirty (30) days.

12. Modificaciones

Tupi Tour reserves the right to update these Terms of Use at any time. The version in force at the time of a specific engagement shall apply to that engagement. Clients are encouraged to review these Terms before each booking.
